In this agreement the company means MARS BUILDHOME DEVELOPERS LIMITED.
Identity Holder (I.H.) means the persons who desire to do business with company in this agreement.

1. I.H. must be at least 18 years of age on the date of application.
2. I.H. must be of sound mind & competent to form agreement.
3. During this agreement I.H. will hold confidence business information & literature which I.H. acquires during the term of agreement.
4. Any person/I.H. can be terminated from the company if he involves in the activities which will affect the company's growth.
5. Commission provided by company could be altered depending upon sole discretion.
6. Company reserves the right to amend rules & regulations from time to time.
7. T.D.S. as applicable will be deducted from the commissions paid to I.H. as per the income tax rules.
8. No refund would be given to any I.H. under any circumstances.
9. This agreement binding upon and is meant for benefit off parties, their heirs and successor in interests, if any' provision of this Agreement found to be unenforceable of invalid, the validity of remaining provision shall not be affected.
10. There is no exclusive territories or franchise granted by company every IH is free to do business anywhere.
11. Any IH can resign anytime while resigning he/she has to surrender his/her IH number which is property of company.
12. All the commission will be subjected to all applicable taxes and other taxes withholding duties and levies.
13. All the benefits/commissions are payable by account payee cheque/demand draft.
14. All the IH should understand the business of the company before signing this agreement.
15. Commission is given to IH when level below him is completed.
16. Company shall not be liable for any incidental or consequential damages caused by breach, cancellation or suspension of this agreement, whether or not such damages is known to the company.
17. IH is an independent contractor (for all purpose, legal purpose include income tax and otherwise) and is neither an employee/legal representative of the company or any other IH nor is the partnership created between IH and company or any other IH by this agreement.
18. In case of IH death his nominee will be entitled to receive the commission.
19. The person authorized by the company will explain business of the company.
20. Company is not responsible if the payment made doesn't reach company office, kindly ensure that your payment is made by Cheque/Demand Draft/Money order in favour of Mars Buildhome Developers Limited. ICICI Bank (Ajmer) Alc No. 018505002501 & Bank of Baroda, Ajmer Alc No. 30190200006917.
21. The IH will get the commission in accordance with the company ie higher the growth higher the commission & vice versa, as subject to as per schedule.
22. The management is having sole discretion to organize training session/presentation/seminar/educational programs and same will be informed by mail to all IH accordingly.
23. Company reserve the right to terminate this agreement at any time forthwith upon given notice in writing to the IH
24. All the above terms and conditions are applicable for every body including nominee.
25. All judiciary proceedings, if any will be in the jurisdiction at Ajmer City.
